Colortrak Print Submission Program: Official Terms

NO PURCHASE NECESSARY. THIS IS NOT A CONTEST OR SWEEPSTAKES. NO PRIZES WILL BE AWARDED. VOID WHERE PROHIBITED BY LAW.

The Colortrak Print Submission Program ("Program") is sponsored by Betty Dain Creations, LLC ("Sponsor" or "Colortrak"), located at 9701 NW 112th Avenue, Suite 10, Miami, Florida 33178.

2. Nature of the Program

The Program invites hair stylists to submit original print and pattern ideas for possible use on Colortrak foils. Submitting does not enter you into a contest or drawing, and no prize, payment, product, or other consideration is offered for submitting. Sponsor may, at its sole discretion, contact a submitter about a potential collaboration. Sponsor is not obligated to review, respond to, select, or use any submission.

3. Eligibility

The Program is open to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years of age at the time of submission and who hold a current, valid cosmetology or barber license. Employees, officers, directors, agents, and representatives of Sponsor, and their immediate family members and household members, are not eligible.

4. Submission Period

Submissions will be accepted from November 5, 2026, at 12:00 a.m. Eastern Time ("ET") through August 1, 2027, at 11:59 p.m. ET (the "Submission Period"). Sponsor may extend, shorten, or end the Submission Period at any time by posting notice on its website or Instagram account. Sponsor's computer is the official timekeeping device.

5. How to Submit

During the Submission Period, go to the official submission page at https://www.colortrak.com/pages/create-our-next-foil, complete the submission form, and upload an image file of your print design. You must provide your full name, email address, Instagram handle (if any), and state of residence.

Submissions are accepted only through the official submission page. Designs sent through Instagram (posts, comments, tags, or direct messages), email, or any other channel will not be considered.

Limit three (3) submissions per person. Incomplete, automated, or non-compliant submissions may be disregarded.

6. Submission Requirements

Each submission must:

Be your own original work, created solely by you;
Not copy, imitate, or incorporate any third party's design, logo, trademark, character, artwork, photograph, or brand pattern;
Not be created in whole or in part with generative AI tools [OR: disclose any use of generative AI tools in the form];
Not have been previously sold, licensed, or committed to any other company;
Not contain obscene, offensive, discriminatory, or otherwise inappropriate content, as determined by Sponsor; and
Be uploaded as a single image file in JPG, JPEG, PNG, GIF, or SVG format, no larger than 30 MB. A clear photo or scan of a hand-drawn design is acceptable.

Sponsor may disregard any submission that does not meet these requirements.

7. Ownership and License

You keep ownership of your submission. By submitting, you grant Sponsor a non-exclusive, royalty-free, worldwide license to store, copy, review, and share your submission internally (including with Sponsor's design and manufacturing partners) for the purpose of evaluating it.

You also grant Sponsor a non-exclusive, royalty-free license to display your submission, with credit to your name or Instagram handle, on Sponsor's website and social media accounts in connection with the Program. You may ask Sponsor to remove a post featuring your submission by emailing social@colortrak.com, and Sponsor will make reasonable efforts to do so.

This license does not give Sponsor the right to manufacture or sell products featuring your submission. That requires a separate written agreement under Section 10.

8. No Obligation; No Confidentiality

Submissions are not confidential. Sponsor has no obligation to review, acknowledge, respond to, return, or use any submission, and no obligation to explain why a submission was or was not selected. No business, employment, agency, or partnership relationship is created by submitting.

9. Independent Development

You acknowledge that Sponsor designs and develops foil prints on an ongoing basis, internally and with outside designers, and receives ideas from many sources. Sponsor may already have developed, or may later develop or receive, prints that are similar or identical to your submission. Sponsor's release of any such print does not mean Sponsor used your submission, and you agree that you are not entitled to compensation or credit for any print Sponsor develops independently.

10. Collaboration

If Sponsor is interested in a submission, Sponsor may contact the submitter using the information provided. Any collaboration, including any use of the design on a product, compensation, royalties, credit, or transfer or license of rights, will be governed solely by a separate written agreement signed by both parties. Nothing in these Terms promises or guarantees any collaboration, payment, or product release. Sponsor may modify, adapt, or combine a selected design only as agreed in that separate agreement.

11. Publicity

If you enter into a collaboration agreement, Sponsor may use your name, city and state, likeness, Instagram handle, and story in advertising and promotion of the resulting product, as further described in that agreement and except where prohibited by law.

12. Your Representations

By submitting, you represent and warrant that: (a) you meet the eligibility requirements; (b) the submission is your original work and you have the right to grant the licenses in Section 7; (c) the submission does not infringe any copyright, trademark, right of publicity, or other right of any third party; and (d) the information you provide is accurate. You agree to indemnify and hold Sponsor harmless from any claim arising from a breach of these representations.

13. Release and Limitation of Liability

By participating, you release and hold harmless Sponsor, Instagram, and their respective parents, subsidiaries, affiliates, officers, directors, employees, and agents from any claims, losses, or damages arising out of your participation in the Program, except where prohibited by law. Sponsor is not responsible for lost, late, incomplete, corrupted, or misdirected submissions; technical failures; or interruptions of internet service or Instagram.

14. Privacy

Information collected in connection with the Program is subject to Sponsor's Privacy Policy, available at https://www.colortrak.com/pages/privacy-policy.

15. General Conditions

Sponsor may cancel, suspend, or modify the Program or these Terms at any time. Changes take effect when posted and do not reduce the ownership rights you keep under Section 7. Sponsor may disqualify any person who violates these Terms or interferes with the Program. Sponsor's decisions are final.

16. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising out of or relating to the Program shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida.

17. Instagram Disclaimer

The Program is in no way sponsored, endorsed, administered by, or associated with Instagram or Meta. You are providing your information to Sponsor and not to Instagram.
